● Deceased Sampat Lal died in a road accident on 19.10.2023 when a motorcycle driven rashly and negligently by Respondent No. 1 collided with his bicycle.
● Claimants (wife and two sons) filed a claim under Motor Vehicles Act, 1988 claiming compensation of Rs. 44,00,000/-.
● Claims Tribunal awarded Rs. 13,94,880/- with 6% interest per annum, fixing income at Rs. 7,410/- per month, and exonerated the insurance company due to breach of driving license condition.
● Claimants filed this appeal seeking enhancement of compensation and direction for 'pay and recover'.
Issues For Consideration
Whether the compensation awarded by the Claims Tribunal needs enhancement and whether the insurer should be directed to pay and recover.
Submissions Of Parties
Petitioner / Appellant
● Deceased was a mason/agricultural worker earning Rs. 15,000/- to Rs. 20,000/- per month, but the Tribunal wrongly fixed monthly income at Rs. 7,410/-.
● Conventional heads compensation is meager and needs enhancement.
● Direction for 'pay and recover' should be issued against the Insurance Company.
Respondent / State
● Insurer submitted that breach of policy condition was correctly established and exoneration by the Tribunal warrants no interference.
Court's Observations & Analysis
Re: Assessment of Income and Compensation Enhancement
● In absence of cogent evidence of earning Rs. 15,000/- per month, monthly income should be taken as Rs. 10,100/- per month as per Chhattisgarh Minimum Wages Notification for unskilled labour.
● Added 40% future prospects, applied multiplier of 15, and deducted 1/3rd for personal expenses considering 3 dependents.
● Enhanced consortium to Rs. 1,44,000/- (Rs. 48,000 x 3), funeral expenses to Rs. 18,000/-, and loss of estate to Rs. 18,000/-.
Held: Total compensation enhanced from Rs. 13,94,880/- to Rs. 18,76,800/-, granting an additional Rs. 4,81,920/- with 6% per annum interest. (Paras 9-13)
Re: Pay and Recover Liability
● Following Supreme Court precedent in Rama Bai v. Amit Minerals, the insurer is directed to pay the compensation amount to the claimants in the first instance and recover the same from the vehicle owner/driver in accordance with law.
Held: Insurance company directed to pay and recover. (Para 14)
Decision & Directions
● Appeal partly allowed; compensation enhanced by Rs. 4,81,920/- along with interest @ 6% per annum from claim filing date till realization.
● Respondent No. 2 (Insurance Company) directed to pay compensation first and given liberty to recover from Respondent No. 1 (Owner and Driver).
