● Under the principal Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026 [Notification No. FEMA 23(R)/2026-RB], exporters were required to declare service exports via EDF, and banks had to record all service imports in IDPMS.
● The RBI has introduced these amendments to streamline cross-border service transactions, reduce procedural burden for individual freelancers, professionals, and small businesses, and optimize data entry workflows for AD banks.
What Has Changed:
Provision Earlier Position New Position Effective From
Definition - Reg 2(1) No explicit clause defining "resident individual" in Regulation 2(1). Clause (da) inserted: "resident individual" means a person resident in India who is a natural person. 01 October 2026
EDF Submission (Resident Individuals) - Reg 3(2) Full EDF reporting required irrespective of entity status or amount. Deemed submitted when a resident individual provides required payment receipt details to the AD Bank. 01 October 2026
EDF Submission (Non-Individuals) - Reg 3(2) Full EDF reporting required for all service exports. Deemed submitted if inward remittance value is not more than ₹10 Lakh (or equivalent foreign currency). 01 October 2026
IDPMS Entry for Import of Services - Reg 18(1)(d) AD banks were required to enter all service import details into IDPMS within 5 working days. AD banks must enter details in IDPMS only for non-individual importers where invoice/contract value exceeds ₹10 Lakh. 01 October 2026
Who Is Affected:
● Resident Individuals: Freelancers, consultants, and individual service providers exporting or importing services.
● Non-Individual Exporters/Importers: Companies, firms, and LLPs engaged in service exports (benefiting from the ₹10 Lakh threshold exemption).
● Authorised Dealer (AD) Category-I Banks: AD banks processing inward and outward remittances for service transactions.
Compliance Action Points:
1. Exporters (Resident Individuals): Ensure complete payment details and remittance purpose codes are provided to your AD bank to ensure automatic deemed compliance for EDF.
2. Exporters (Entities other than Individuals): Verify if inward remittances for service exports fall at or below the ₹10 Lakh threshold to utilize the deemed EDF submission route.
3. AD Banks: Update internal processing workflows and software to filter out service import entries for resident individuals and non-individual invoices below ₹10 Lakh from mandatory IDPMS logging.
Analysis & Impact:
● For CA / CS / Tax & Legal Professionals: Advising individual clients and small corporate service exporters on simplified FEMA compliance. Document retention remains critical for tax and audit purposes even if formal EDF filing is deemed complete.
● For Businesses & Investors: Significantly lowers administrative burden and operational delay for small-value cross-border software, consulting, and digital service transactions.
● For News Readers: Individuals selling online services globally no longer need complex paperwork for receiving funds from abroad.
● Points to Watch: Procedural guidelines or operational FAQs from RBI to AD banks regarding updated purpose code reporting.

Frequently asked questions about FEMA & FCRA
- What is the difference between FEMA and FCRA?
- FEMA, the Foreign Exchange Management Act, 1999, governs foreign exchange transactions, foreign investment and external commercial borrowings, and is administered by the RBI and the Central Government. FCRA, the Foreign Contribution (Regulation) Act, 2010, regulates foreign donations to NGOs and other persons, and is administered by the Ministry of Home Affairs.
- What is compounding under FEMA?
- Compounding lets a person voluntarily admit a FEMA contravention and settle it by paying a sum, instead of facing adjudication. Under Section 15 of FEMA it is done by the RBI or the Enforcement Directorate, at the authority's discretion. It is not available once an appeal against an adjudication order has been filed.
- How long is FCRA registration valid?
- FCRA registration is valid for five years. Renewal must be applied for online on the FCRA portal before expiry, ideally within the six-month window before it expires. If renewal is refused, the registration is treated as expired from the date of refusal.
- Where must foreign contributions be received?
- Since the 2020 amendment, foreign contributions must first be received in the designated 'FCRA Account' at the State Bank of India, New Delhi Main Branch. They cannot be transferred to other persons, and administrative expenses are capped at 20 per cent.
