The Bombay High Court has revived a public interest litigation (PIL) concerning the maintenance of potholes in the Mumbai Metropolitan Region, despite declining to initiate contempt proceedings against the Brihanmumbai Municipal Corporation (BMC) for prior non-compliance. The court acknowledged the BMC’s efforts to address the issue but reiterated the necessity for immediate corrective actions regarding the road conditions. Chief Justice D.K. Upadhyay emphasized public welfare, instructing civic bodies to submit a detailed compliance affidavit within eight weeks. The original PIL was filed in response to ongoing concerns about poor road conditions affecting safety and mobility. Although the court had previously considered disposing of the case due to challenges from intervenors, it recognized the urgency of the matter. The next hearing is scheduled for December 3, 2024, where the court will assess the BMC’s compliance and evaluate further actions to ensure the improvement of public infrastructure.
