Delhi High Court Rules In Favour Of 'Dream 11' In Trademark Infringement Suit Against Replica Website
The Delhi High Court ruled in favor of Dream 11 in a trademark infringement suit against a replica website. The court permanently enjoined the defendant from using Dream 11’s trademark, logo, or tagline and ordered the transfer of the domain name ‘dream11com.in’ to Sporta Technologies. The court found that the defendant’s website misled the public by using Dream 11’s registered marks and redirected users to a betting site. The court noted that the defendant took unfair advantage of Dream 11’s reputation and goodwill, deceiving consumers by adopting the plaintiffs’ registered marks without plausible explanation.
