The Madras High Court has upheld the validity of a circular issued by the Insolvency and Bankruptcy Board of India (IBBI) that grants financial creditors the right to propose or recommend resolution professionals in applications filed under Section 95 of the IBC. Section 95 deals with insolvency applications filed by operational creditors against individuals. The High Court reasoned that allowing financial creditors to recommend resolution professionals in such cases can contribute to a more efficient and faster resolution process.
