ITAT affirms Deductibility of ESOP Expenses as Legitimate Business Expenditures u/s 37 of Income Tax Act
The Income Tax Appellate Tribunal (ITAT) has affirmed the deductibility of Employee Stock Option Plan (ESOP) expenses as legitimate business expenditures under Section 37 of the Income Tax Act. The ruling came in a case where the taxpayer claimed deductions for ESOP expenses, which were initially disallowed by the assessing officer. The ITAT held that ESOP expenses are incurred wholly and exclusively for the purpose of business and are therefore deductible. This decision provides clarity on the tax treatment of ESOP expenses and supports the view that such expenses are legitimate business costs.
