ITAT sets aside Income Tax Penalty on Fruit Dealer for Misreporting, Directs CIT(A) to Reconsider Immunity Despite Form 68 Lapse
The Income Tax Appellate Tribunal (ITAT) has set aside a penalty imposed on a fruit dealer for the misreporting of income. The tribunal has also directed the Commissioner of Income Tax (Appeals) [CIT(A)] to reconsider the dealer's plea for immunity from penalty, despite a procedural lapse in filing Form 68. Form 68 is filed to seek immunity from penalty when an assessee has made a disclosure of additional income. The ITAT took a lenient view, holding that a procedural lapse in filing the form should not be the sole reason for denying the substantive benefit of immunity, especially if the assessee has otherwise cooperated and paid the due tax. By remanding the matter, the ITAT has given the assessee another chance to have their case for immunity considered on its merits by the appellate authority.
