Motor Accident: Jharkhand High Court Upholds Rs. 50.90 Lakh Compensation To Kin Of Deceased Lawyer
The Jharkhand High Court upheld a compensation award of ?50.90 lakh to the family of a deceased lawyer who died in a motor accident. The court dismissed an appeal by Bajaj Allianz General Insurance, which challenged the compensation on grounds of non-compliance with permit regulations. The court ruled that non-compliance with permit regulations does not constitute a fundamental breach of the insurance policy. The deceased lawyer was fatally injured when a rashly driven Tempo collided with him. The Motor Accident Claims Tribunal had awarded the compensation, directing the insurance company to pay and recover the amount from the vehicle’s owner. The court noted that the driver had a valid license and the insurance was effective at the time of the accident. The decision reaffirms the liability of insurance companies in motor accident cases and the protection of victims’ rights.
