PC Act | Preliminary Enquiry Can Be Dispensed With If FIR Is Based On Detailed Source Report Submitted To SP : Supreme Court
The Supreme Court held that a preliminary enquiry under the Prevention of Corruption Act (PC Act) can be dispensed with if the FIR is based on a detailed source report submitted to the Superintendent of Police (SP). The court reasoned that if the initial information leading to the FIR is already thoroughly vetted and documented in a reliable source report, a separate preliminary enquiry might be unnecessary and could cause undue delay in initiating investigation into corruption allegations.
