The Gujarat High Court noted a misunderstanding by the Chief Secretary regarding the implementation of the Rights of Persons with Disabilities (RPwD) Act, 2016. The court observed that the calculation of vacancies and recruitment exercises showed a lack of understanding of reservation laws. The Chief Secretary’s affidavit stated that vacancies not subjected to the complete selection process could not be treated as backlog vacancies. The court emphasized the need for a fresh exercise to compute posts for persons with disabilities in each department, including public sector undertakings. The court also highlighted the importance of implementing the Supreme Court’s 2013 judgment in Union of India vs. National Federation of the Blind, which mandates reservation for persons with disabilities in government establishments. The court directed the state to ensure proper implementation of the RPwD Act and the earlier law to provide reservation in every government establishment.
