The Supreme Court has asked the Delhi High Court to expedite its decision on an interim injunction in the case between Roche and Zydus Lifesciences. The case involves a patent infringement dispute over the manufacture of a breast cancer drug by Zydus. Roche has filed a patent infringement suit against Zydus, alleging that its drug ‘Sigrima’ is a biosimilar of Roche’s patented drug ‘Perjeta’. The Delhi High Court had restored an injunction order restraining Zydus from manufacturing, selling, or marketing ‘Sigrima’. Zydus challenged this order in the Supreme Court, which has now remitted the matter back to the Delhi High Court for an expedited decision. The Supreme Court’s directive aims to ensure a timely resolution of the matter, which has significant implications for both companies and the pharmaceutical industry.
