Society Cannot Restrain House Help From Rendering Services To Resident Who Feeds Stray Dogs In The Premises: Bombay High Court
The Bombay High Court issued an order in a case where a society sought to restrain its resident from feeding stray dogs, alleging the activity caused nuisance. The petitioner, a society member, filed a complaint asserting that the feeding resulted in an increase in the number of stray dogs, leading to sanitation issues, disturbances, and even security concerns. However, the court observed that while the society's concern for cleanliness and safety was valid, it couldn’t directly impose restrictions on feeding stray animals, as this would hinder an individual's right to feed animals. The court further noted that there was no legal provision preventing people from feeding stray animals. Thus, the petition was dismissed, allowing the individual to continue feeding the dogs.
