State Adding Seats Few Months After Onset Of Recruitment Process But Not Revising Eligibility Cut-Off Date Against 'Equal Opportunity': Rajast
The Rajasthan High Court ruled that the state cannot add new vacancies to an ongoing recruitment process without revising the eligibility cut-off date. The court found that splitting additional vacancies into two fractions violates candidates’ fundamental rights. The court emphasized that Rule 16 of the Rajasthan Ayurvedic, Unani, Homeopathy, and Naturopathy Subordinate Service Rules does not permit such division. The court noted that adding 247 seats to the existing selection process without changing the application date deprived eligible candidates of equal opportunity, violating Articles 14 and 16 of the Constitution. The court underscored that the interpretation of laws should align with citizens’ rights under the Constitution.
