Writ Petition Can Be Entertained When Order U/S 9 Of Arbitration Act Neither Grants Nor Refuses Relief: Kerala HC
The Kerala High Court held that a writ petition can be entertained when an order passed under Section 9 of the Arbitration and Conciliation Act neither grants nor refuses relief. Section 9 allows courts to grant interim measures during arbitration proceedings. The High Court's view is that if the Section 9 order is ambiguous or inconclusive, it does not constitute an effective alternative remedy, thus allowing for writ jurisdiction.
