Family & Personal Law Services

Family lawyers in India — divorce and mutual-consent divorce, custody, maintenance, domestic violence, family disputes and NRI divorce by verified advocates.

Family & Personal Law matters are among the most personal a person faces — the end of a marriage, the care of children, financial support, safety at home and disputes within the family. WCP's verified family-law advocates explain the options under the personal law that applies — Hindu, Muslim, Christian, Parsi or the Special Marriage Act — and guide clients through negotiation, mediation and the Family Courts.

What is covered:

  • Divorce, mutual-consent divorce and child custody
  • Maintenance and alimony
  • Protection from domestic violence and harassment
  • Family property and partition disputes
  • Divorce assistance for NRIs
  • Medical negligence claims

Where safety is at risk, urgent protection orders can be sought immediately; other matters often settle faster through mediation.

Frequently asked questions

How long does a mutual-consent divorce take?
Under the Hindu Marriage Act there is a six-month cooling-off period after the first motion, which courts can waive in suitable cases; many mutual divorces conclude in about six to eighteen months.
Who gets custody of children?
Courts decide in the child's best interests; custody can be sole or joint, with visitation for the other parent.
Can a wife claim maintenance?
Yes — under Section 144 of the BNSS (formerly Section 125 CrPC), personal laws such as Section 24 and 25 of the Hindu Marriage Act, and the Domestic Violence Act.
What protection does the Domestic Violence Act give?
Protection orders, residence orders, monetary relief, custody orders and compensation, through the Magistrate, with interim relief possible quickly.
Can a foreign divorce decree be recognised in India?
Only if it meets the conditions of Section 13 of the Code of Civil Procedure; decrees on grounds unknown to Indian law, or obtained without proper participation, may not be recognised.
Is mediation used in family disputes?
Yes. Family Courts routinely refer matters to mediation and counselling before adjudication.
