Bank Account Freeze

Help when a bank account is frozen — identifying the authority, bank representations, and court applications to release funds.

Bank Account Freeze
Estimate Cost
₹10,000 – ₹75,000
Typical duration
15 days

Service overview

  • A bank account can be frozen by the bank itself (KYC or suspicious-activity flag), by the police or cyber cell during an investigation (Section 106 BNSS, earlier Section 102 CrPC), by a tax or enforcement authority, or by a court.
  • Often the account holder never did anything wrong: money that passed through your account is linked to someone else's fraud complaint, and the whole account is blocked.

Who needs it? / When is it needed?

  • Your salary or business account shows a debit freeze or lien and you do not know why.
  • You received money from a person later reported as a fraudster (a common trap in UPI and trading transactions).
  • The bank says "police have asked the WCP professional to hold the account" but has given no written notice.

What to expect from the WCP Professionals

  • Take the full story first. WCP professionals ask when the account was last used, who sent the disputed money and why, and whether any police station has contacted you. Clients often disclose only part of the facts at first; WCP professionals draw out the rest, because it decides the strategy.
  • Identify the real freezer. A bank-side KYC or compliance hold is usually fixed quickly with documents. A police or cyber-cell freeze, a tax attachment, or a court order each needs a different remedy. WCP professionals tell you plainly which one you face and how long it is likely to take.
  • Test legality. Under Section 106 BNSS the officer must report the seizure to the jurisdictional Magistrate forthwith, and courts have held that failing to do so, or having no link to the alleged offence, can make the freeze unsustainable. Recent High Court rulings have also held that a lien should be confined to the disputed amount unless material links the rest of the balance to the offence.
  • Separate your clean money from the disputed money. WCP professionals prepare a transaction-wise explanation showing the source of the disputed credit (a genuine sale, a loan repayment, a trading counterparty) and the clean source of the rest.
  • Use the right ladder. Written representation to the bank's Nodal Officer; the cyber-fraud grievance route (bank, Investigating Officer, District and State Grievance Officers) where the freeze arises from a 1930/NCRP complaint; an application to the Magistrate for defreezing or release of the undisputed balance; and, in suitable cases, the High Court.

Key deliverables

  • Freeze-cause report (freezing authority, legal basis, amount held)
  • Written representation to the bank's Nodal Officer and the Investigating Officer
  • Transaction explanation and supporting evidence file
  • Application to the Magistrate for defreezing / partial release

Standard turnaround time

  • Bank-side holds: typically a few days to 2 weeks after complete documents.
  • Police or cyber-cell freezes: generally several weeks to a few months, depending on the Investigating Officer and the court's listing. Under the cyber-fraud grievance route, banks are expected to submit a grievance within about 7 days of the complaint. Timelines are indicative and cannot be guaranteed.

Government fees, timelines & key outcomes

  • Government fee: none for a bank representation or grievance; a nominal court fee and affidavit / stamp-paper charges apply for Magistrate and High Court applications.
  • Key outcome: release of the account in full, or release of the undisputed balance with a lien limited to the disputed amount, plus a written order or confirmation. Release does not close the underlying police investigation

Forms & filings involved

  • Representation to the bank
  • Nodal Officer, and grievance on the NCRP-CFCFRMS grievance module via the bank
  • Application to the Magistrate under Section 106 BNSS framework for defreezing
  • Reply to any police notice (Section 35 BNSS) and affidavit of source of funds

Documents required

  • Bank statements for the period (ideally 12 months) and a copy of any bank or police notice or SMS
  • Identity, address and PAN KYC
  • Proof of the disputed transaction (invoice, chat, agreement, UPI screenshot, UTR)
  • Proof of source of funds for the rest of the balance (salary slips, ITR, GST returns)
  • FIR or complaint number, if known

What we need from you

  • Tell the WCP professional the full, honest story from the start, including anything you think looks bad.
  • Do not move or hide funds from other accounts.

Important conditions

  • WCP professionals cannot promise release; if the court finds the money is traceable proceeds of fraud, it may remain held.
  • A freeze under a court or tax order needs that forum's remedy, not a bank request.
  • If you are an accused in the case, criminal-law advice and possibly separate engagement may be needed.

Additional information

  • Freezes can also come from tax or enforcement action (such as GST or income-tax provisional attachment), each with its own remedy.
  • Cyber-fraud victims can use the same grievance route to recover wrongly held funds.
  • Banks should inform you of the reason in writing; ask for it in writing.

The estimated cost covers indicative professional fees only. Government fees, stamp duty and taxes are payable at actuals.

How it works

  1. 1. Raise a service enquiry describing your requirement.
  2. 2. A Relationship Manager reviews it and opens it for bidding.
  3. 3. Pay into escrow and assign the professional you select.
  4. 4. Track progress to completion, then accept and release payment.

Frequently asked questions

Why do banks freeze accounts after a cyber complaint?

If money linked to a reported fraud passes through your account, the cyber cell can ask the bank to freeze it while the transaction is investigated.

Can the whole account be frozen for a small disputed amount?

Courts have repeatedly said the freeze should usually be limited to the disputed amount, and applications can seek release of the rest.

How do I get my account unfrozen?

Find out which authority ordered it, give your explanation and source of funds, and if needed apply to the Magistrate or High Court for release.

How long does defreezing take?

From a few days where the bank or police release it, to several weeks where a court order is needed.
