The Allahabad High Court took suo motu/public-interest cognizance (as framed in the petition) of allegations of illegal encroachments and the erection of makeshift religious structures within a public park in Lucknow. Observing the competing interests of protection of public spaces, environmental considerations, civic amenity rights and freedom of religion, the Court directed a fact-finding inquiry to ascertain the nature, extent, and legality of the encroachments and the formation of temporary/permament religious structures in the park. The order calls for a report from relevant civic authorities and municipal agencies, with a view to determine whether the occupation is unauthorised, whether procedures for sanction or sanctioning authorities were followed, and what remedial measures are necessary to restore public land and protect the public interest. The judgment seeks to preserve the rule of law in respect of public property while ensuring that any action taken respects constitutional freedoms; it balances civic governance and communal sensitivities and signals judicial insistence on administrative accountability in protecting public spaces and urban amenities.
