Allahabad High Court Permits VC, Executive Council Members Of KGMC To Move Discharge Applications Before Contempt Court
The Allahabad High Court allowed the Vice-Chancellor and Members of the Executive Council of King George's Medical University to seek discharge of notices in pending contempt proceedings. The court emphasized that Rule 5 of Chapter XXXV-E of the Allahabad High Court Rules, 1952 requires a prima facie case of contempt before issuing notices. \r
The court noted that contempt proceedings, being quasi-criminal, need a higher standard of proof and must not be initiated casually. The appellants contended they were not part of the resolution violating a court order, and the court underscored the importance of judicial application of mind and adherence to procedural requirements. \r
The case was sent back to the single judge with liberty for the appellants to seek discharge.
