The Supreme Court held that objections to an auction sale under Order XXI Rule 90 CPC cannot be entertained if the grounds were available to the objector before the proclamation of sale but were not raised at that stage. The Court emphasized procedural discipline in execution proceedings and the need for finality. Permitting belated objections after sale confirmation can cause injustice to bona fide purchasers and delay execution. However, the Court clarified that challenges based on fraud or fundamental irregularities may still be entertained if they vitiate the sale. The judgment balances the rights of judgment-debtors and auction purchasers by requiring timely objections. It reiterates that execution proceedings cannot become a playground for dilatory tactics and that litigants must exercise their rights at the appropriate stage.
