In a recent decision, the State Consumer Disputes Redressal Commission, Siliguri Circuit Bench, West Bengal, allowed an appeal by Canara Bank regarding a complaint involving the theft of a motorcycle financed by the bank. The Commission found no deficiency in service on the bank's part, emphasizing that the complainant's dispute was primarily with the Insurance Company, which had repudiated the claim for the stolen motorcycle. The Commission noted that the complainant's failure to promptly report the theft to the police and discrepancies in the FIR contributed to the insurance company's decision. As the bank's role was limited to financing the motorcycle purchase and not managing insurance claims, it should not be held liable. The Commission overturned the District Commission's decision and modified the order, relieving the bank from any financial responsibility in the case.
