Bombay High Court restrains Astral Adhesives from using container similar to M-Seal PV Seal

The Bombay High Court has granted a temporary injunction against Astral Adhesives, preventing them from using containers resembling those used by Pidilite Industries' solvent cement, M-Seal PV Seal. Justice Firdosh P Pooniwalla ruled in favor of Pidilite, stating that denial of the injunction would cause significant harm and prejudice to the plaintiff. \r

Pidilite argued that Astral's containers and labels for Solvobond closely mimicked their registered design, including distinctive features like shape, configuration, and cap design. Astral defended their use, claiming Pidilite's design lacked novelty and artistic merit. \r

However, the court upheld Pidilite's contentions, finding no evidence that Astral's designs existed prior to Pidilite's registration. Consequently, Astral was restrained from continuing to use containers similar to Pidilite’s until further proceedings. Pidilite was represented by Senior Advocate Virag Tulzapurkar and advocate Hiren Kamod from Khaitan & Co.
