Builder Fails To Deliver Flat In Time, Karnataka RERA Orders Refund To Homebuyer
The Karnataka Real Estate Regulatory Authority, led by Neelmani N Raju (Member), mandated the builder to reimburse a homebuyer for a flat due to failure in delivering possession as per the agreed deadline of 31.03.2021. \r
The complainants had booked a flat in Shriram Greenfield Phase - 2, paying Rs. 22,93,626 towards the total price of Rs. 51,19,700 by 15.06.2019, and secured a housing loan via a tripartite agreement. Despite completion of only five floors by 2018 and no further progress observed, the homebuyers sought a refund. \r
The Authority dismissed the builder's contention, citing Supreme Court precedent and Section 18 of RERA, which ensures refund of the amount paid along with interest and compensation for delays. Consequently, the builder was directed to refund Rs. 34,08,420/- with interest within 60 days.
