The Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has quashed a penalty that was imposed on the director of a diamond firm. The penalty was related to allegations of misdeclaration and overvaluation in the company's export consignments. The tribunal, after reviewing the evidence, found that the department had failed to provide any concrete proof to substantiate its claims of misdeclaration or to show the director's personal involvement in any fraudulent activity.
