CESTAT Sets Aside Excise Duty Demand

CESTAT held that the excise duty demand on subcontractors performing road/flyover job work was time-barred. It ruled that the department failed to establish suppression or wilful misstatement to invoke the extended limitation period. Since the construction activity itself is exempt and fully disclosed, demands raised after delay were unsustainable.
