CESTAT Upholds Rs. 50K Penalty on Customs Broker for Failing to Verify Misdeclared Import Weight
The Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has upheld a penalty of Rs 50,000 imposed on a customs broker for their failure to properly verify the weight of an imported consignment which was misdeclared. The tribunal held that customs brokers have a statutory duty to exercise due diligence and to ensure that the information declared in the import documents is accurate. In this case, there was a significant discrepancy in the weight of the imported goods, which the broker had failed to detect or report. The CESTAT observed that such negligence on the part of the broker can facilitate customs violations. By upholding the penalty, the tribunal has reinforced the professional responsibility of customs brokers and has sent a message that they will be held accountable for any lapses in their duty of care.
