A Bengaluru Consumer Court ordered Flipkart to refund ₹13,799 to 80-year-old Purnachandra Thoudam for delivering a different product as a replacement for his original order. Additionally, Flipkart must pay ₹10,000 in compensation and litigation costs for the mental agony caused.
The court rejected Flipkart's defense that it was merely an intermediary, holding the company liable for service deficiency. Thoudam had ordered a treadmill in June 2023, which was found defective and returned. The replacement, from a different company, also had issues, prompting the complaint.
The court found sufficient evidence that Flipkart failed to deliver the correct product and ruled in favor of the complainant.
