Delay In Delivery Of Possession, New Delhi District Commission Holds Ansal Landmark Townships Liable
The District Consumer Disputes Redressal Commission-VI, New Delhi, chaired by Ms. Poonam Chaudhry and Shri Shekhar Chandra, held Ansal Landmark Townships liable for negligence and deficiency in service due to failure in delivering possession of a booked unit within the stipulated time frame. \r
Despite the agreement requiring completion within two years from the commencement date, the Builder did not inform the Complainant about the status of construction or possession timelines. The Commission cited delays in possession as both a deficiency in service and an unfair trade practice, referencing Supreme Court precedents. \r
It ordered the Builder to refund Rs. 6,90,379/- with interest at 9% per annum, compensate Rs. 1,00,000/- for mental anguish, and pay Rs. 25,000/- as litigation costs to the Complainant.
