Headnote:
The Delhi High Court dismissed a petition by the defendants seeking to place additional documents on record in a money recovery suit after nearly seven years. The Court found that the application failed to explain the inordinate delay, did not specify the nature or relevance of the documents, and lacked credibility regarding the alleged office shifting of the defendants. The Court held that admitting the documents at such a late stage would prejudice the plaintiff, and the petition was held to be frivolous and devoid of merit. Costs were imposed on the petitioners.
Background:
- The respondent/plaintiff filed a money recovery suit in May 2016. After filing a Written Statement in June 2017, issues were framed by the trial court on 11 October 2017.
- The plaintiff concluded evidence on 05 June 2023. The defendants/petitioners sought to file additional documents at a stage when their evidence was to be recorded.
- The trial court dismissed the application, noting a delay of almost seven years without explanation and lack of disclosure regarding the documents’ relevance or prior availability.
Court’s Observations:
- The petition failed to explain why the documents were not filed at an appropriate stage, and no reasons were provided in the original application regarding office shifting.
- There was no indication that the documents were not already in the possession of the defendants.
- Introducing the documents at this stage would prejudice the plaintiff, who never had an opportunity to address them.
- The Court found the petition devoid of merit and entirely frivolous.
Legal Provisions Discussed:
- Order VIII, Rule 1A, Code of Civil Procedure, 1908 – Power to allow additional documents during trial.
Decision
- The petition and accompanying applications were dismissed.
- Costs of Rs. 10,000/- were imposed on the petitioners to be deposited with DHCLSC within one week.
- The trial court was directed to be informed of this order.
