The Delhi High Court dismissed the petition challenging the execution court’s order directing arrest warrants against the judgment debtor. The Court held that the execution court of Shahdara District had territorial jurisdiction based on the debtor’s address at the time of filing the execution proceedings. The petitioner’s claim that he resided elsewhere at the time of the order was irrelevant. The Court also observed that the debtor was deliberately evading legal process, justifying the issuance of arrest warrants.
Background:
- The petitioner/judgment debtor challenged the order dated 09.10.2025 of the execution court, which issued warrants of arrest returnable on 14.11.2025, later extended to 06.12.2025.
- The petitioner argued that the Shahdara District court lacked territorial jurisdiction because he resided in Karawal Nagar (North-East District).
- The dispute arose after part payments were made on a decree following a settlement, but the petitioner stopped paying and appearing in court.
Court’s Observations:
- Territorial jurisdiction is determined based on the address at the time of institution of proceedings, which was Jhilmil Colony (Shahdara District) for the petitioner.
- The petitioner’s later change of residence did not affect the court’s jurisdiction.
- The petitioner was found to be intentionally evading the legal process.
- The execution court’s issuance of arrest warrants was justified under these circumstances.
Decision:
- The High Court dismissed the petition and upheld the execution court’s order.
- Costs of Rs. 10,000/- were imposed on the petitioner/judgment debtor to be deposited within one week.
