Delhi High Court on Parking Policy: Traffic Police Expert Recommendations to Prevail over Layout Plan Claims.

The Delhi High Court dismissed an appeal filed by the Patparganj FIE Entrepreneurs Association challenging the permission granted to the Municipal Corporation of Delhi (MCD) to develop a parking facility along the main arterial road of Patparganj Industrial Area. The Court held that issues relating to traffic management and parking feasibility fall squarely within the domain of traffic authorities, whose expert opinion must be given due weight. It observed that once the Traffic Police, after conducting a detailed survey, recommended limiting parking to one side of the road to ensure smooth vehicular flow, the Court would not interfere with such technical determinations. The Court declined to examine the statutory force of the layout plan, holding that such technical matters are beyond judicial review unless arbitrariness or mala fides are shown.
• The appellant, Patparganj FIE Entrepreneurs Association, comprising industrial units engaged in IT, printing, packaging, and automobile services, challenged an MCD letter dated 27 December 2023 proposing a parking facility on the main road of the industrial area.
• The appellant contended that the layout plan earmarked specific parking plots, which should have been utilized before converting any arterial road into a parking site.
• It argued that the proposed parking would cause congestion, inconvenience, and safety hazards to both workers and visitors.
• The learned Single Judge, in W.P.(C) 92/2024, had directed MCD to act based on the Traffic Police’s Survey Report, which suggested parking on only one side of the road to balance space and traffic flow.
• Dissatisfied, the appellant filed the present appeal (LPA 942/2024), arguing that the Traffic Police exceeded its mandate and that the Single Judge ignored the binding nature of the layout plan.
• The Division Bench upheld the Single Judge’s decision, emphasizing that traffic regulation and road-use planning are within the exclusive competence of traffic authorities, not the courts.
• The Traffic Police’s affidavit (dated 18 August 2025) demonstrated a thorough understanding of local conditions and recommended parking only on one side to prevent congestion.
• The Court held that such recommendations, supported by field data and technical reasoning, cannot be lightly interfered with by judicial review.
• It reiterated that layout plans and Master Plan provisions (MPD-2021, Parking Rules 2019) were not directly in question, as the issue before the Court was confined to whether the proposed parking would impede traffic flow.
• Observing no arbitrariness or mala fides, the Court refused to invoke its extraordinary jurisdiction under Article 226 to substitute expert administrative judgment with judicial opinion.
• The appellant was, however, given liberty to submit a representation to the Delhi State Industrial Infrastructure Development Corporation (DSIIDC) regarding other grievances.
The Letters Patent Appeal was dismissed, affirming the Single Judge’s order directing MCD to proceed in accordance with the Traffic Police’s survey recommendations. The Court granted liberty to the appellant to make a representation before DSIIDC for any residual issues concerning infrastructure or layout compliance.
