The Delhi High Court quashed an FIR registered under Sections 498A, 406, and 34 of the Indian Penal Code (IPC) after the husband and wife amicably settled their matrimonial dispute. The Court reiterated that in cases arising out of matrimonial discord, continuation of criminal proceedings after a genuine settlement would be an abuse of process of law and against the ends of justice.
• The FIR was lodged by the wife alleging cruelty and misappropriation of her stridhan against her husband and in-laws.
• Subsequently, both parties entered into a settlement before the Delhi Mediation Centre, wherein all disputes were resolved and permanent alimony was paid.
• The wife confirmed before the Court that she had no objection to the FIR being quashed.
• The Court emphasized that matrimonial offences are largely personal in nature and do not have a serious impact on society when parties reconcile.
• Referring to precedents like Gian Singh v. State of Punjab and Narinder Singh v. State of Punjab, the Court observed that once the parties have settled their disputes voluntarily, continuation of proceedings would cause unnecessary hardship and defeat the purpose of justice.
• The Court found the settlement bona fide and not a result of coercion, fraud, or undue influence.
The FIR and all proceedings emanating therefrom were quashed, and the petition was allowed.

• Section 406, Indian Penal Code, 1860 – Criminal breach of trust.
