The Delhi High Court recently issued an interim injunction against Southern Infosys Limited, barring them from using the mark ‘INFOSYS’ in any capacity following a lawsuit by Infosys Limited for trademark infringement [Infosys Limited v. Southern Infosys Limited].
Justice Sanjeev Narula's order on May 27 restrained the defendant from using ‘INFOSYS’ in their corporate or trade name, or in any manner that could infringe Infosys' trademark rights. The Court dismissed Southern Infosys Limited's argument that ‘INFOSYS’ is generic, affirming that it has acquired secondary meaning associated specifically with Infosys.
Despite acknowledging Infosys' delayed legal action, the Court upheld their rights under trademark law due to continuous usage of the mark.
