Delhi High Court to hear Tesla vs Tesla Power case next on 28 May
The Delhi High Court will hear Tesla Inc's trademark infringement case against Gurugram-based Tesla Power India Pvt Ltd on May 28. Initially scheduled for a hearing on Wednesday by Justice Anish Dayal, the case was deferred due to time constraints. On May 2, the court issued a notice in response to Tesla Inc's plea, restraining Tesla Power from advertising EV products with a similar trademark and instructing Tesla Power to reply to the allegations. \r
Tesla Inc filed the lawsuit to prevent Tesla Power from using the "Tesla" trademark, arguing that it caused consumer confusion and harmed its business interests. Tesla Inc claimed that Tesla Power's advertisements misled consumers into buying their batteries, assuming they were associated with the US company. Legal experts believe this case could set important precedents in IP law for the EV industry. \r
The court criticized Tesla Inc for not showing urgency, noting that the dispute had been ongoing since 2020, and emphasized that Tesla Power deserved a fair hearing. Tesla Power argued that it only sells lead-acid batteries for conventional vehicles and inverters, not EV batteries. Chairman Kavinder Khurana clarified that their advertisements related to a strategic partnership with e-Ashwa, and affirmed no plans to enter the EV market.
