Domestic Violence Act Doesn't Distinguish Between First Or Subsequent Marriage For Maintenance: Delhi High Court
The Delhi High Court has ruled that the Domestic Violence Act makes no distinction between a first or second marriage for the purpose of awarding maintenance to a second wife. Justice Swarana Kanta Sharma upheld a trial court's order of ₹1 lakh per month in maintenance for the wife. The court emphasized that once a person voluntarily enters into a marriage, they assume statutory obligations, and the Domestic Violence Act aims to protect all women experiencing domestic violence, irrespective of the marital order.
