Failure To Deliver Possession Of Units Within Reasonable Time, Southwest Delhi Commission Holds Metro Max Infrastructure Liable
The District Consumer Disputes Redressal Commission-VII, Southwest Delhi bench comprising Suresh Kumar Gupta (President), Harshali Kaur (Member), and Ramesh Chand Yadav (Member) held Metro Max Infrastructure Ltd accountable for deficient services by failing to deliver possession of properties despite receiving advance payments. \r
The Complainant had booked two shops and a residential plot in Jaipur's "Lotus Valley" township, paying a total of Rs. 4,02,777/-. Despite receiving substantial payments, the Builder reduced the plot area unilaterally and failed to register the properties, claiming lack of actual land availability. The District Commission ruled this as deficiency in service and an unfair trade practice. \r
Citing Supreme Court precedent, it ordered the Builder to refund Rs. 4,76,271/- with interest and pay Rs. 1,00,000/- as compensation for mental agony and litigation costs to the Complainant.
