The Foreign Exchange Management (Overseas Investment) Directions, 2022, have been amended to clarify the regulations regarding investments in overseas funds. The amendments allow investments in units or any other instrument issued by investment funds overseas, subject to regulation by the financial sector regulator in the host jurisdiction. \r
Listed Indian companies, resident individuals, and unlisted Indian entities in International Financial Services Centres (IFSCs) are permitted to make such investments. The amendments aim to provide clarity amidst diverse regulatory frameworks governing investment funds across jurisdictions. \r
These changes, issued under the Foreign Exchange Management Act, 1999, aim to facilitate Overseas Portfolio Investments (OPI) while ensuring compliance with regulatory requirements. AD Category-I Banks are instructed to notify their constituents accordingly.
