General Insurance Sector Receives Rs 18K Crore Relief as GST Council Drops Tax Demand

Ahead of the Union Budget, the general insurance sector received significant relief worth over Rs 18,000 crore as the GST Council dropped a substantial tax demand on insurers. The General Insurance Council (GI Council) announced the cancellation of GST demands on co-insurance and reinsurance commissions, as well as on reinsurance for crop insurance schemes, benefiting insurers and farmers. The GI Council argued that the GST demands on these commissions lacked a legal basis and would adversely affect farmers. After extensive consultations with industry stakeholders, the GST Council's decision was confirmed on June 22. The GI Council successfully argued that co-insurance and reinsurance transactions should be considered "no supply" under the CGST Act, leading to the cancellation of past GST cases. The exemption on reinsurance premiums for government crop insurance schemes was also extended to cover the period from July 1, 2017, to January 23, 2018. The industry continues to advocate for a reduction in GST on individual health insurance policies.
