GST Order without Stating Clear Reasons for Rejection of Taxpayer's Reply Cannot be Sustained : Madras HC
The Madras High Court ruled that a GST order rejecting Jupiter & Co's reply without clear reasons is unsustainable. The petitioner, a dealer under the Tamil Nadu VAT Act, 2006, had submitted detailed replies to a show cause notice. Despite this, the impugned order issued on April 30, 2024, summarily dismissed their explanations.
Justice Senthilkumar Ramamoorthy noted the order's lack of reasoned explanation. The court set aside the order and remanded the case for reconsideration, directing the respondent to provide a reasonable opportunity, including a personal hearing, and to issue a new order within three months from receiving the court's order.
