Gujarat High Court Sets 45-Year Minimum Age for Senior Advocate Designation
The Gujarat High Court has introduced a minimum age criterion of 45 years for eligibility to be designated as a Senior Advocate. Under the newly notified ‘The High Court of Gujarat (Designation of Senior Advocates) Rules, 2025’, prospective candidates must have at least 20 years of standing at the bar, practicing ordinarily before the Gujarat High Court or district courts and specialized tribunals. Additionally, aspirants must demonstrate ability, legal acumen, special knowledge or distinction, a good reputation, and participation in pro bono legal work. The Rules impose a ban on Senior Advocates from mentioning cases or seeking adjournments in court, delegating these responsibilities to junior lawyers. Senior Advocates are mandated to mentor and maintain at least 2 to 3 young lawyers with less than 3 years of experience, promoting skill development within the legal community.The application process will be conducted annually through a permanent Secretariat constituted by the Chief Justice and requires endorsement by two Senior Advocates with at least 10 years’ standing. Applicants must submit 50 judgments from the past five years, and details for those practicing outside the High Court may be obtained from judicial officers. A full Court decision, based on consensus or majority, will finalize designations, with the ability to revoke the status for professional misconduct. If an application is denied, a fresh application is permitted only after two years. The new regulations aim to enhance transparency, maintain professional standards, support junior lawyers’ development, and refine the administrative aspects of conferring Senior Advocate status, reflecting evolving judicial expectations and practices in the legal profession.
