Haryana RERA Orders Builder BPTP To Pay Interest And Pass Benefit of Increased Super Built-Up Area To Homebuyer
The Haryana Real Estate Regulatory Authority (Authority), under Sanjeev Kumar Arora (Member), ruled in favor of a homebuyer against a builder for delays in possession and unauthorized increases in super built-up area. \r
The builder failed to deliver possession by the stipulated date of 07.12.2016 as per the Flat Buyer Agreement, leading the Authority to direct payment of interest for the delay at 10.85% per annum from the due date until possession was offered on 13.12.2021. \r
Additionally, the Authority mandated the builder to provide the increased super built-up area of 2191 sq. ft. to the homebuyer without imposing any additional costs, affirming violations of Section 11(4)(a) of the Real Estate (Regulation and Development) Act, 2016.
