Haryana RERA Orders Interest To Homebuyer For Delayed Possession, Also Holds Agreement Is Biased
The Haryana Real Estate Regulatory Authority (Authority) found the buyer's agreement terms heavily biased in favor of the builder for the Gurgaon Greens project. Despite objections, the Homebuyer had to proceed due to forfeiture risk. \r
The authority observed the agreement's unfairness, where the builder imposed stringent clauses, including forfeiture and high delay payment charges. It deemed the possession terms uncertain and unjustly favored the builder. \r
Hence, the authority directed the builder to pay interest to the Homebuyer at 10.85% from the due possession date until the possession offer, plus two additional months, for violating Real Estate Act provisions.
