HP High Court Clarifies Pensioners Eligible for Reemployment under Punjab Police Rules
The Himachal Pradesh High Court held that police pensioners remain eligible for reemployment under Rule 12.25 of the Punjab Police Rules, even after seeking voluntary retirement. The case involved Prem Lal, who joined the police force in 1986 as a constable, rose to Assistant Sub-Inspector by 2012, and opted for voluntary retirement due to family circumstances. Subsequently, he applied for reemployment in 2014, but the State rejected his application on the grounds that voluntary retirees are ineligible. Justice Sandeep Sharma clarified that Rule 12.25 provides three independent conditions under which reemployment is permissible: i) discharge with compensation; ii) discharge with invalid gratuity; or iii) receipt of pension. The use of “or” implies that fulfillment of any single condition suffices for eligibility. Since the petitioner was receiving a pension, he fell within the scope of the rule. The Court directed authorities to reconsider his application within two weeks, reinforcing the principle that voluntary retirement does not preclude reemployment if pension rights exist. This judgment strengthens pensioners’ employment rights and interprets statutory provisions in favor of individual entitlements.
