Income surrendered during survey treated as business income, not unexplained investment: ITAT deletes higher tax u/s BBE
This article reports an ITAT decision where income “voluntarily surrendered” during a tax survey was held to be assessable as business income, not as unexplained investment under Section BBE (provisions for unexplained investments). Consequently, the Tribunal deleted applying the harsher “unexplained investment” regime. The judgment clarifies the nature and treatment of income disclosures in surveys and helps taxpayers understand how surrendered amounts may be taxed more favorably rather than under penal classifications.
