The Himachal Pradesh High Court held that insurers cannot deny legitimate claims by relying on undisclosed or hidden policy clauses that were not brought to the insured’s notice in a clear manner. The Court stressed good faith and transparency obligations in insurance contracts, observing that exclusions or conditions that operate to defeat cover must be conspicuously disclosed at the time of issuance and reasonably understood by the policyholder. The decision reaffirmed consumer protection principles in insurance—insurers bear the onus to communicate limitations and cannot engraft surprise clauses after the event. The ruling bolsters insured parties’ rights to compensation where denials rest on obscure contractual language and directs lower fora to construe ambiguous clauses in favour of policyholders.
