The Delhi High Court rejected InterDigital Technology’s plea to access licensing agreements between Chinese mobile phone manufacturers and two SEP licensors, Ericsson and Orange SA. The court directed both InterDigital and the manufacturers to furnish licensing agreements with Qualcomm instead. \r
The ruling is part of an ongoing patent infringement suit filed by InterDigital against Oppo, RealMe, and OnePlus. The court considered the relevance of agreements between the defendants and Qualcomm to determine if the doctrine of exhaustion applied. \r
Additionally, a Division Bench allowed the defendants to furnish a bank guarantee from an Indian bank instead of making a court deposit, overturning a single-judge order. The main suit is set to continue hearing on July 3.
