Jammu & Kashmir High Court Directs Maruti Suzuki and Dealer to Pay ₹16.5 Lakh Compensation for Supplying Defective Car
The Jammu & Kashmir High Court ordered Maruti Suzuki and its authorized dealer to compensate a consumer with ₹16.5 lakh for supplying a defective car. The buyer had alleged that soon after purchase, the vehicle exhibited recurring mechanical defects that were never satisfactorily rectified despite repeated servicing. The Court observed that both manufacturer and dealer owe a duty of care to ensure that products sold are free from latent defects. It held that failure to address the consumer’s grievances amounted to deficiency of service under consumer protection principles. The judgment emphasized that consumers should not suffer harassment, mental agony, or financial loss because of negligent practices by large corporations. The Court further noted that the auto company’s brand reputation could not absolve it of liability for specific defective products. By imposing joint liability, the Court reinforced accountability across the supply chain. This decision reiterates strong judicial commitment to consumer rights, ensuring that individuals receive fair redress against corporate negligence in goods and services transactions.
