Kerala HC Grants Relief to Spice Exporter: Stays Coercive Action Until Appeal is Heard
The Kerala High Court has granted relief to a spice exporter, staying coercive action until its appeal is heard. The Income Tax Department had initiated recovery proceedings despite the company's appeals and stay petitions pending before the National Faceless Appeal Centre (NFAC). The High Court acknowledged the pending matters and directed the Commissioner of Income Tax (Appeals), NFAC, to dispose of the stay petitions within three months. Until a decision is made on these stay petitions, all coercive recovery steps against the exporter have been ordered to be kept in abeyance, ensuring due process.
