The Kerala High Court closed a contempt petition alleging violation of an interim child custody order, after recording the respondent-mother’s submission that there was no wilful disobedience of the Court’s judgment. The Court accepted the respondent’s undertaking to hand over interim custody of the child to the petitioner-father during the Christmas holidays and held that no further contempt action was warranted.
• The petitioner-father filed the contempt petition alleging that the respondent-mother had violated the High Court’s judgment dated 09.10.2025 by refusing to hand over interim custody of their child during the Christmas holidays.
• The alleged violation pertained to non-compliance with directions issued in Mat. Appeal No. 639 of 2025.
• The petitioner asserted that despite the judgment, the respondent failed to permit interim custody, compelling him to initiate contempt proceedings.
Submissions Before the Court• Counsel for the respondent submitted that there was no deliberate or wilful violation of the judgment.
• It was contended that the respondent could not comply with the interim custody arrangement as the petitioner did not contact her to take custody of the child.
• An undertaking was given on behalf of the respondent that the child would be handed over to the petitioner from the Court itself on the same day and retained by him until the evening of 31.12.2025.
Court’s Observations• The Court recorded the submissions and undertaking made on behalf of the respondent.
• It found no reason to initiate contempt proceedings, noting the absence of wilful disobedience of the earlier judgment.
• The Bench emphasised that compliance with custody arrangements flowing from judicial orders must be ensured in letter and spirit.
Decision• The contempt petition was closed.
• The respondent was directed to abide by the undertaking given before the Court and to comply with the judgment implicitly in the future.
