Kerala High Court Imposes Cost On Bank For Illegally Retaining Client's Documents After Closure Of Loan
The Kerala High Court has imposed costs on a bank for the illegal retention of a customer's property documents even after the loan for which they were pledged had been fully repaid. The court strongly deprecated the bank's conduct, stating that once a loan is cleared, the bank has no legal right to hold on to the security documents. The bank had reportedly retained the documents due to a dispute related to a different loan account of a family member. The court held that this was an arbitrary and high-handed action that caused undue hardship to the petitioner.
