The Kerala High Court modified the interim bail conditions imposed on a life convict, holding that a condition prohibiting the petitioner from entering the jurisdiction of his native police station was unduly stringent and would defeat the purpose of granting bail. The Court lifted the restriction while imposing reasonable reporting obligations to balance liberty with public safety.
- The petitioner, Vivek T.R, is accused No.10 in S.C. No. 698/2019 before the Additional Sessions Court, Ottapalam, and is serving life imprisonment as Convict No.C-211/2023 in the Central Prison and Correctional Home, Thavanoor.
- He had been granted ordinary leave/interim bail under Ext.P1 order, which included the condition that he shall not enter the jurisdictional limits of Ottapalam Police Station, Palakkad, and shall not contact any residents therein.
- The petitioner challenged these conditions as unreasonable since his residence is situated within the jurisdiction, making the restriction practically impossible.
- The Court noted that the condition barring entry into his own locality defeats the purpose of interim bail.
- No reason was provided in the order for imposing such stringent restrictions.
- The Court emphasized the need to balance the liberty of the petitioner with the requirement to prevent interference with the complainant or residents of the area.
- The condition restricting the petitioner from entering the jurisdictional limits of Ottapalam Police Station is lifted.
- The petitioner is directed to report before the SHO, Ottapalam Police Station, every Monday at 10 am.
- The petitioner is prohibited from contacting relatives of the deceased residing within the jurisdiction.
- The writ petition is disposed of accordingly.
- Article 226, Constitution of India – High Court’s writ jurisdiction to secure fundamental rights and enforce legal remedies.
- Ext.P1 interim bail order – Conditions for release of a prisoner on bail.
